Holiday pay

Hi everyone! I have over 400 hours of holiday that I’ve accrued during maternity leave. I am currently thinking to apply for a different position within the same company, but the new job is paid a lot less. The question is, when it comes to using the holidays that I accrued in my current position, will they be paid at the new (lower) hourly rate? Thank you ☺️

No, it would be within the position you accrued them. I kind of did this I went from full time post to a different part time post in the same company- all the leave I accrued from my full time posting was carried over. I tried to ask them to pay me it but they refused and said they would only pay if I was leaving the company. It caused such a mess due to dropping to part time

I believe if you swap to a new job within the company you loose the hours unfortunately

@Kelly thanks for your reply! Can I ask if your different jobs were paid the same? Because I think my new position will be paying over £1 less per hour which is a lot of money for more than 400 hours so I’m not sure what to do 😩

Can you take the accrued hours as a block at the end of your mat leave? That’s what i did before returning to work.

It was the same pay but I did get a completely new contract with it. I don't think they would be able to because your start date for your new employment would be after you've accrued them so if you took them to tribunal im pretty confident you'd win. You could reach out to pregnant then screwed they're really helpful! But also reach out to your HR and ask them directly- if they tell you it will be the lower rate then you've got more time to challenge it but I really don't think it should be a problem but I'm not an expert 🤣

You do not lose your accrued holiday hours nor the rate at which they are paid. You can either take them right at the end of your maternity leave or request to be paid them instead.
