I’d talk to the labour board of your province about making a complaint because you are supposed to go to your exact same position when you return
It depends if you just started back. I know I have to go on modified work duties when I go back next year because they want to ease you back into it instead of expecting you to work 40 hours with a little one
@Robin, with the split shift, it'll be nearly impossible to see my daughter. She'll be in daycare.
that is my fear with returning after mat leave! everyone says they can’t do that to you but so many employers do… i would definitely make a complaint higher up in the company if possible and if nothing then take it to labour relations 🤷♀️
HR Manager here: Do you have a union? If so, I'd speak with your union representative. If not, then I'd look-up the Employment Standards in your province and find the specific language that you believe your Employer is contravening, and write to them stating that you expect to be reinstated to the same or similar work you were performing prior to your leave. If they do not, then you may consider filing a complaint under the Employment Standards Act for your province. Alternatively you may seek advice from an employment lawyer. Some companies offer EAP services that include legal services as well. Best of luck mama. I'm sorry you're having to deal with this 😔
@Jess not a union. Guess i shouldn't be shocked. They wrote me up for my HG symptoms. I plan to look for new work.
I hope you are able to secure a new job. I would recommend contacting your labour board as what they are doing is highly incorrect.

@Nikki trust me. After my miscarriage things started going south. Had to take a lot of time off because the ER didn't care for me, then having HG with my rainbow baby.
Your not supposed to get a step down, when taking maternity leave is Canada your position is essentially saved for you until your maternity leave is done. If they are not able to provide the same position they are required to provide a position at the same level not lower
