Sole Custody; Absent Parent
Hi ladies. Has anyone successfully obtained sole custody when an absent parent was listed on the birth certificate? I’m being told that I can’t get custody without serving the father but we haven’t seen or had any contact with the father in years, don’t have any contact information for him, and had a restraining order for our safety years ago so serving him isn’t something I’m interested in doing in the least (ie: I am not willing to reach out to anyone that may know his whereabouts because I don’t feel safe doing so). Any way around this?? I can’t get my son’s passport without sole custody. Thanks in advance.
Hi . Message me. I’ve been through this. The father must be served regardless. You can hire a process server or send a friend or family member over the age 18 you have to attempt at last known addresses or last know places of employment. Once all unsuccessful , and you show your attempts to have him served, the hearing will be held in his absence and you could be granted custody of your son. The fact that he cannot be found speaks volumes for itself in which the court will recognize that.
