I've made the decision to move out of state. But my only issue is that the father of my kids doesn't think like me. As a woman, I want to feel safe and make sure they will be too. I don't believe that I will stay safe here in the south. Every week, it's something new they are dismantling. I'm worried about the DOE being closed. I've gotten off topic, so I told him my plans to move, but he has said they can't go out of the state with me. We never went through the court. I can leave and they will be able to visit me. Told me they couldn't live with me once I'm settled. So my question is if I do move and he still says they won't stay with me. Can I get a family lawyer involved? Would my case win?
Usually it depends if your kids are old enough to speak for themselves (and can say who they want to live with), their maturity level, and how well they are doing in school. I would definitely get a family lawyer involved. Especially if your kiddos dad is saying it isn’t going to happen. This has been my experience in CA at least.
