Child Support court

Hey ladies, I’m so anxious because I have court next month. I had to file contempt of court papers because my ex-husband has failed to pay child support. He’s upset because I’ve moved on and had the nerve to think that because I have another child that support is going towards my current husband’s and i child. We were divorced, and the child support order was put in long before i got remarried. He’s focusing on the wrong things. My current husband has been helping me take care of our children because their father fails to. Has anyone ever had to deal with this? He’s currently over 35k behind in child support for our children and it has only been a little over a year. In GA do they make him pay a certain percentage when we go to court or would they put him in jail? I just wish i had a crystal ball to know what’s going to happen. He’s still employed and makes almost 200k a year. There’s no reason why he shouldn’t support his children financially

I work in child support in OH, so of course it's going to vary from state to state. When we refer a case for contempt of court, typically the judge orders a 30 days in jail OR pay a "purge" amount(usually an extra 20% each month until arrears are paid). Of course, if he's already fallen behind, this amount may already be a past due charge. That past due charge would turn into the purge charge. If he still doesn't pay, the case would be referred back to the court for a trial to impose the 30 day jail sentence.

Thank you. I read so much online and i think that’s what’s making my anxiety, even worse. It’s upsetting because he thinks it’s OK and also because this isn’t the route that I wanted to take, I really tried to work with him. But when I thought about it, our two children are the only children that he has and he’s failing to take care of them. He can he just doesn’t want to and I should not have to give him so many chances for not taking care of his responsibility because i do it everyday.

Does he have a normal job? Not under the table? I'm not sure why you're not getting payments if you know where he's working. What has your case worker done about it?
