So I read up on the Texas family code that u have to have new evidence to do an enforcement on someone and not use recycled claims. So after we have tried to serve my ex six times and have been unsuccessful he decided to go and have me served a citation for enforcement of child visitation using February 21 as his evidence that I violated the court order when technically I had a Po that prohibited him from being at my house! So legally he wasn't supposed to be there but he was and he is trying to use that against me! The police even notified him of the Po and said he's not to come near my house or me and my son! How was his file accepted by the 309 court if technically that was a violation on his part?

Is his evidence dated? Because he may be lying to the courts if it isnt. If youre able to provide proof of date, youre entitled to sue.

@Nichole he put February 21 2025 but that date my protection order was effective and he came by my house and recorded me while I was in my own room talking to my dad to see if I can borrow his phone to make a report the police even told him that he isn't allowed at my house

@Jazmine okay, well you need to submit a copy of the protection order, potentially again, to show he violated the order & you may even need to request a new judge if they fail to recognize the risk he is.

@Nichole im gonna request a lawyer and see if they can do all that I literally just got served Monday and didn't even get time to find an attorney

The enforcement doesn't make sense at all

You need to make sure the PO includes your child. If it doesn’t you technically have to find a middle person to set up visitation. Now whether he violated your PO would be a completely separate case unless it includes your child. In that case send that to the judge and show. Definitely ask for a lawyer
