Can you take annual leave after statutory maternity pay has stopped?

My statutory maternity has now stopped as it’s been 9 months. I’m still taking another 3 months unpaid but my question is can I now use annual leave so I get paid or do I need to wait until my maternity leave is over?

I did this I had 2 weeks annual leave straight after my maternity I did pre plan this with my employer though, maybe worth contacting them 🙂 x

You can take AL but it needs to be when your maternity leave is over! So say for example you may want to end your leave after 9 months, you can then bulk on anything that you’ve accrued over your leave

You can use it but it counts as ‘return to work’ even though you’re going straight to annual leave. There’s often a minimum notice period though to return so contact your employer asap and let them know you’d like to return but use your annual leave up first before your actual return.

I think it may depend on each company, as I asked to me paid my remaining from last year , and they said I couldn’t because I was still on leave .. so in my case I had to take my unpaid leave ( which ended yesterday, and then the would of been able to use holiday when I ‘returned’ to work.. or you’ll have to not take your unpaid leave to take holiday so you’re not going without money if that makes sense? But then you’ll be actually returning sooner.. I would just give your HR / management a call and ask :-) x

I think best to double check with HR/people team at your work if possible. My understanding is you would need to end your maternity to use annual leave but my workplace requires certain notice period if I wish to move up my end date, but at there discretion they could be agreeable without the notice! Best to speak with your work, although understand if you are asking because you work are not the nicest bunch (sorry if thats the case). Have a look at your contract and then next place to check is ACAS or gov uk websites - I’m sure there is a helpline you can ring.

Yes you can do I am ‘returning to work’ September 9th and using 7 weeks of annual leave. I will go back to work full time on 28th October. You need to give 8 weeks notice of your ‘return to work’ date though x

You are entitled to 10 keeping in touch (KIT) days, that would help you get some pay but I think your mat leave would end if you start using annual leave. My understanding is you still accrue it on mat leave but can't use it during. Unfortunately. The unpaid part does suck, I'm not looking forward to that

Yes, but it’s ends your maternity leave so you need to take the annual leave for the very last weeks as you can’t go back on unpaid after

Yes but like others have said, you need to “return to work” and then use your annual leave, so you need to have a chat with your work place asap if you wish to use it. So just to be clear, your maternity ends so you can’t do a few weeks annual leave and then go back to maternity. I’m adding mine at the end of the 12 months and then also using it for phased return and to go down to 4 days.

Yes, but as others say it has to be when mat leave has ended. So if you are choosing to do the 3 months unpaid (to take you to 12 months) you cannot take AL in those months. Annual leave is classed as being back at work. I am taking 9 months and then taking my Annual leave for 24/25 at the end, so I am away for 10+ months but my return date for work is 1st April.

Yes, you accrue annual leave when you’re on maternity leave so you can take it after and stay off for longer. Be careful how much you take though. I took half of mine because I wanted to still have some for the rest of the year when I go back x

If you take your annual leave you will end your maternity leave so make sure you’re ready for it to end
