NJ Disability question

Hi ladies! 40 y.o FTM from NJ and am very confused regarding my temporary disability. I thought after birth, we get 12 weeks from the state? I had my baby on 8/13 via c section but my doctor put the recovery date as 10/18. Does this mean I won’t get paid after 10/18? I’m out on maternity leave until January, and starting to freak out. Please advise! TIA

@Katie its okay, i get it!, i went through hell, even my company was like whaaat, they didn't know. Give me a few minutes and I can explain.,

So disability and family leave insurance go hand in hand. For disability you can get 4 weeks before your due date or delivery date and 6-8 weeks after for a combined 12 weeks. For family leave insurance it’s also 12 weeks is taken consecutively or 8 weeks if take intermittently.

@Katie okay so, every state is different, for NY its 6 weeks + 1 week as a grace period for vaginal and c section is 8 weeks + 1 week grace, that's through met life (the insurance company my company chose) in conjunction with NY State, then, maternity is mandatory in NY if your company doesn't offer paid leave, the state will pay 67% salary, so for me I got 19 weeks, if I had any complications I would have up to 26 weeks in total, all that aside, do you know the insurance company your company has the policy in place? You can find that out on your HR platform.

That date can be adjusted, if I was in your shoes, if I had given birth on the 13th, I would have been paid from August 5th, the claim would have gone through the week prior, because it takes a week for their payroll to pick up.

@Anela if it’s NJ specific and the job doesn’t have disability insurance it’s the above that I wrote. I have std insurance and they pay the 15% difference of the 85% the state pays.

So its std with New Jersey Directly? Then you should be able to call them and adjust the date. Std is paid out 1 week prior to birth.

It depends because if she did a c section, she may not be able to adjust it to a week prior. I depends if it was planned in advanced or last minute before she went on disability. At least for nj I was 10 days late and my doc had to certify that I was late to be paid beyond the 4 weeks before

I believe you would get paid from birth and then for 12 weeks for Family Leave for Newborn Bonding (that is what I am currently doing)

My start date for disability was 8/5. C section was unplanned. I thought it was 12 weeks from the start date 🤷🏼‍♀️

I am a teacher and don’t get disability, just the NJFLA, so it may be different for you. I called the state a few times and they were actually helpful. Also, this is the website I used: https://www.nj.gov/labor/myleavebenefits/worker/maternity/

@Nelly yes, i went back to work early because the only financial help i got were from parents, food stamps & WIC......They send a debit card in the mail so you have to go to Wawa or Walgreens, take out only X amount each day then deposit that into your bank account, they don't direct deposit it & u cannot take it all out at once

Wow, I filed 2 months in advanced and was paid as soon as I gave birth because I gave them time to process everything, and I had three weeks of pto to cover me, but that's defiantly not my experience in general with these types of things. And it may have been different for NY.

@Anela NJ doesn't allow us to file early, you have to wait until the baby is out

@Rebecca thats crazy, they allowed me to file an estimate, it wasn't even processed but the paperwork was in the system, so once I did they updated it and proceeded it, that's surprising that, that wasn't allowed. But I guess that's the difference with private insurance vs state.
