All I can say is document everything. Try to have every conversation over text so you can screen shot it. If you can get proof of the dui that would help your case.
I'm sorry you are going through this, i would definitely take it to court Where do you live?? I'm pretty sure there should be some resources in your area, you're going to need a caseworker to help you make a strong case agains your ex.
California notoriously sides with the mother. The DUI should be plenty to be able to get full custody. I’d make sure all communication is via text so you have it in writing.
Besides the DUI, does he smoke weed? And if he does, ever around your kids?? My ex used to do that and even drove high with the kids.. I live in California and that totally helped me get full custody.
@Lupe` Ventura county. Yes he does smoke. He also got another DUI just under a year ago & drives with the kids without a license
@Aliayah I do have audio of my son stating his father drinks & drives. That’s what made me push for court after he started voicing these things to me. Do you think that’s anymore helpful? Also his second DUI within a year
Im sorry that you have to go through this my ex left me with his baby three months ago and now a new girl and got her pregnant im so alone as well and i wish i had more support so i do hope you have evidence to take him to court!!

Do wellness checks on your kids when their at dads house! Maybe ask your kids to record him drinking then driving and text you what’s going on to have proof. Unfortunately sometimes our kids have to speak up and do the responsibility of the adults. They can call the police for help as well. Maybe buy them a bed for dads, it’s not about helping him but keeping your kids off the floor, my prayers to your family!
From personal experience the judge isn’t going to care about a DUI. My step kids mom got a DUI and a child endangerment charge and the courts didn’t care. They sent back the court papers with it saying denied and “ mom is to not drink alcohol during her parenting time”
