Maternity rights

Does anyone work in employment law or HR or have experience in either? My maternity leave replacement has been advertised externally with the same duties as mine but with a senior stuck in front of my existing job title. The pay has also been advertised at 20% more than my current base pay. I am a senior member of staff, and have been with my company for many years, so I am very confused this has been done behind my back. Can anyone offer any advise before I go back to my head of department/HR on what my rights are? Thanks

Assuming they are only advertising a 9-12 month role - I believe usually the pay is increased to entice someone into the role due to it only being a fixed term/mat cover. I have no idea regarding the title of the job though x

HR here and yes they can advertise the role with an increase in pay, it’s usually to make a temporary role more enticing for applicants and happened to my role as well. It’s a bit galling but they’re not discriminating and you can always bring it to them when you return that you would expect to keep the updated title and salary if you want to try for a pay rise. Also remember what they advertise is not necessarily what’s agreed with the new member and that will be a private discussion between them x

Ugh I have the same thing but I’m in Canada, apparently it’s a common practice as this person will not need that much training apparently and I’m gone only for 6 months so that my hubby can have parental leave too for the remainder of the year. But it’s so unfair and I want that sr title and pay increase lol

Temps usually get more as they don’t get all the benefits like pension contributions, sick pay and holiday…. Well that’s what our company offered. They can accrue holiday but we didn’t offer them the benefits contracted staff were as they were not staying

@Carley there is a difference between a fixed term contract (for the likes of maternity cover) and a temporary contract (like a Christmas temp), temps don’t get benefits but a ftc would be entitled to certain ones…but yes they normally get paid a higher rate to encourage them to take the role x
