Redundancy on maternity leave

Hi all, wondering if anyone can help or share some advice. I found out that I was being made redundant when my baby was 4 weeks old and was given a final consultation date. I was also issued a payment estimate, this was based on my average earnings 12 weeks prior to the notice being issued however I attended my final meeting this week and was given a completely different figure significantly lower and told the new payment estimate is based on 12 weeks prior to this new date (at which time I was already on maternity leave) therefore the new payment is based on my statutory maternity earnings and not the earnings of what I was working prior to going on Mat leave, is this right? This sounds unfair, I want to contest it but want to be sure first. Tia x

I don’t know if this is legal. Do you have the original figure on an email? - I recommend reaching out to citizens advise as they can help you with what your entitled to etc

Oooof I’m sorry this is happening to you. It doesn’t sound great! The ACAS helpline is good and probably worth having a chat with them or citizens advice as Freya suggests. Good luck x

Try contacting the charity Pregnant Then Screwed, they should also be able to offer advice and support but this doesn't sound right. It's very very difficult to make someone redundant when on maternity leave, and as it's a protected characteristic you 100% shouldn't be treated any differently by being on leave.... The fact they are basing your payment on stat pay means they *are* treating you differently as a result of your maternity.

@Freya thank you, yes still have everything on my emails and a hard copy too. Will try citizens advice also x

@Alex will try Acas as I read lots of useful information on their website, thank you x

@Em this is really helpful, I never thought about it like this but you’re 100% right thank you so much x

If you have copies of what they have offered initially I think they would need to uphold that. Like Em said them giving you stat pay is also treating you different and them revoking initial pay to offer stat pay is treating you different so I do feel like you have a case here to push back. Good luck I’m so sorry you’re going through this x

I would call Acas (I used to work for them) - they're a government body that offers free and impartial advice on employment law. The number is 0300 123 1100. X

@Beth Thank you, I will definitely get in contact x
