If you have only been on statutory maternity pay I believe you would still be entitled to the the money unless you started a new job before maternity would end. I might be wrong but I didn’t go back to work (but didn’t start a new job either) and was entitled to all of my stat pay because I got this due to the time I had already worked not because I was returning back. You would obviously need to give your notice in at work when you know what you are doing before you are due back from maternity. They would then calculate any money they might owe you like annual leave you haven’t taken. If you have had occupational maternity pay from work on top of statutory then this would be different and you would need to check your work policies.
My pay was 6 weeks of normal wage, and it went down to 80%, but on my payslip is says statutory pay? So does that mean I would need to pay it back??x
Possibly. I was told by work I'd need to do 1 keep in touch day even if I wasn't planning on returning after. I'm now on bank with them and have done 2 shifts since May x
Statutory pay is about £180 per week. If you have been receiving more than this then it’s likely you have an enhanced maternity pay package. Many places require you to return for a period otherwise you have to pay back the extra (anything over statutory). For example I work for the NHS and have to return for three months or pay back the enhanced pay. However not every workplace sets this requirement so you would need to check your maternity policy.
Just give your notice like you normally would. When is your 39 weeks up ? Your May pay will automatically end, if you’ve only received stat pay you won’t have to pay any back. Only if you received enhanced pay from your company x
