@Asha I spoke to them last week and told them my start date of my new job 😩 I’ll ring again today
I thought being employed elsewhere immediately stopped your SMP.
@Lisa — but I’m not starting the job until after my maternity finishes?? Just all the paperwork is getting sorted?!
Could it be worth having a look at your contract and the company policy on maternity pay as well? If it turns out you are still entitled to SMP then your employer has to pay it, if she refuses then contact ACAS
Contact HMRC to ensure they have the correct start date for your new job and confirm that they agree you are still entitled to the remaining payment from your previous employer (they can send this in writing to both you and your employer). ACAS can't help with SMP as it's a statutory entitlement. Only HMRC can help you but be warned, they are very slow. X
@Rosie if you are already on their payroll then that will class as being employed by them. Which ends your SMP through your previous employer.
@Lisa I understand but they’ve told that payroll company I don’t start until 2 days after my maternity pay finishes? My employment doesn’t end with my current employer until the day my maternity pay finishes. It must all just be a misunderstanding. I can’t pay my mortgage on Friday without this payment?
@Emily Thankyou: will ring at 8.30 when they open It just makes me cross because I spoke to hmrc last week and told them about 10x my job starts 25th nov and I’m entitled to maternity until 23rd! And my notice to my current employer finishes on 21st November x
@Rosie it’s not really a misunderstanding. As soon as you are on another companies payroll, that counts as being employed, which immediately terminates your SMP through your other employment.

As someone who works in finance, I agree with Lisa. If you’ve gone onto the payroll, you’re now employed by them. Regardless of whether you’ll actually be paid or not. I don’t understand why they’ve done it so early if your start date isn’t until end of November.
So was all sorted. My current employer had the full lump sum given to her. The payroll company just hadn’t sorted the payslip. My official finish date with my current employer is the day my maternity finishes.. and my start date has been told to hmrc that it’s 2 days after my mat finishes. Thanks everyone for your comments x
@Lisa but I’m not actually working until 25th November, so if anythjng ever comes up I would be able to prove I have earnt nothing from them? Basically I’m a nanny, so they use a company called nanny paye, so it has to all be set up in advance to be able to receive a contract etc.
