This is discrimination right?

I have been placed on stage 1 sickness today for 3 episodes of sickness in the past 6 months; 2 of the 3 are pregnancy related, for a high risk pregnancy, (the baby is diagnosed with a birth defect and I have some issues too) one of the 2 pregnancy episodes was a day in hospital... I'm more than sure that should not trigger attendance management and that it is discrimination??

Pregnancy related sickness should not be counted towards attendance management.

Yeah, I work in HR and that's not right. Way to make a stressful situation worse for you!

My work automatically triggers stage 1 review if sickness go over a certain number (my work uses the Bradford scale) the stage 1 is then sent to the area manager for individual evaluation 2 of my sickness on my current stage one are pregnancy related from having my 7 month old and I was told would not count against me when assessed.

It does state on the government website pregnancy sickness doesn't count. I'd print that off and give it to them and state that if they do not take the two counts of sickness that happened during your pregnancy off they're breaking the law and you may consider suing them for discrimination. Might scare the pants off of them to get their backside in gear

That’s is correct. However they can force earlier maternity leave depending how far along you are. HR told my manager I had to take mine 4 weeks earlier than planned due to pregnancy related health issues impacting work when I had absences due to being in hospital

@Asha oh really? Okay il do this! I did call them right at the start of all my issues but they said they couldn't give me tailored advice for my case and to go to citizens advice / employment lawyer. But il call back and see! X

@Danielle yes I read that earlier today actually! I'm only 26 weeks so I'm not due just yet. Iv always been very open with my health issues ans work and been open and honest about the issues in my pregnancy from the get go, like I was the first time round. So they're aware of all my risks and extra needs etc xx

Pregnancy related illness shouldn’t count. I told them really early after being admitted to hospital with hyperemesis and they put it as separate to other sickness. It was quite high already after a miscarriage related infection, but my work haven’t pushed either case sickness wise.

As long as you’re upfront with them, then you’re covered yourself. I was too, kept them informed the whole way along. And in all fairness, the job I do does impact others if I am not 100% myself. So I understood the stance they had to take. As well as them looking out for mine and babies health. It is most likely the attendance stage 1 has been automatically flagged and they’ll have the follow up conversation with you to see how they’re able to support you further and make any further reasonable adjustments. Work did that for me plenty of times until eventually they weren’t able to make anymore and it was safer for me to be off work at 35 weeks. I hope all goes well for you work and health wise xx

Definitely not right! I had a few occasions of pregnancy related sickness/absence and it didn't go against me at all. My company were actually very good to me when I was pregnant

So it was explained to me in a previous trust that they can still trigger meetings etc so they can demonstrate that they have met with you, offered support etc and they can still call these “stage 1” etc but that they can’t discipline you for it it take any kind of action like give warnings etc
