I believe that is true only if you sign a prenup

We sign nothing at all

What is prenup as I’m not from the us

So I’m confused

It depends on that state you live, but most have equitable distribution in cases of divorce. A prenup is something you sign before marriage to protect your assets.

In California, courts will divide their property according to community property laws if a couple divorces without a prenuptial agreement.

I live in Pleasanton

If the spouse owned the home before marriage, and NO marital assets were used to pay the mortgage, or improve it, then it may remain separate property.

any assets that were acquired during the marriage are split equally between both spouses.
