Pregnancy Discrimination?

I told my employer that I was pregnant when I was 6 weeks pregnant(1st of September) due to some issue and I had to leave work for a day and having some issue with morning sickness I was in and out, and today 16th of September my boss and I had a meeting where he told me that my position at work is not longer needed and that I was being made redundant. Apparently there is not money to justify my position but they just hired a Operation manager. Is this what’s called “Pregnancy Discrimination”? If so what should I do next? Should I fight back? Should I just stay with what they offer me? 2 months pay as gesture of “Goodwill” my redundant letter says which I found manipulation to say that it’s a gesture of goodwill

Pretty sure there’s a law that states they have to follow a certain process with redundancy that includes you being made aware it may happen and a consultation period. I’d ring ACAS for some advice

Do you have any documentation of telling them you are pregnant? Any emails or anything? If so keep a copy safe in case you need it later

Girl I’m so sorry! but you are protected as you told him early on! Go to ACAS for advice on the next steps. they will have to pay your maternity leave for sure. How many weeks pay were you going to be entitled to? x

@Hattie yes, im going to speak with ACAS. Im not sure of how many weeks because the couln’t be bothered to inform me about that. I didn’t even have a pregnancy risk assessment

@Trinidad does your company publish their maternity leave policy? Were you a permanent employee?

@Hattie they don’t even have a maternity leave policy, I couldn’t find it anywhere and yes, I was a permanent employee:(

@Trinidad If your employer doesn't offer enhanced maternity pay, they must pay statutory maternity pay. This is 90% of your average weekly earnings for the first six weeks of maternity leave. Once you’ve spoken to ACAS they should be able to help your draft up a letter to tell the company they need to pay you that. Xx

HR girlie here - you could be protected under the Protection from Redundancy (pregnancy and family leave) act 2023. Absolutely contact ACAS to check your rights x

@Sophie oh does that means they have to re admit me?

@Trinidad without knowing the whole situation it’s difficult to comment but I would definitely speak to ACAS. Make sure you do so asap as there is a time limit in making claims.
