Divorce

Can anybody tell me the difference between filing for divorce and filing for separation. Me and my husband separated and I really want to file for divorce and be done with him but I have no money right now for court filing fee and he’s not going to pay. And we have 2 kids together and he wasn’t there at the hospital to sign neither birth certificates. However 2nd child is deemed his since we were married at the time of conception.

Note different states co mingle property and assets differently But separation would recognize you aren’t together. Some states if you were to buy a home for example as a separated woman it would be solely yours. Some states not exactly. Please check your states assets laws. But you are still legally married, if you only separate. Things you got jointly during marriage are still jointly owned. Bills or anything from when you were together are still joint. So insurance benefits. You would still be next of kin technically in emergencies Divorce is a complete dissolution of the marriage union. Also check with your court house. I was able to get waived fees
