Urgent advice pls

I live in the uk and me and baby daddy we don’t have a healthy relationship anymore, he been so emotionally abusing me and no respecting me or my mum that came over when I gave birth 3 months ago to help me out I am from Spain and I want to go back to my family and settle down there as in the uk I have no one a part him. My baby is 4 month old now and we are both in his birth certificate. I don’t see any future in this country for me or for my baby. Am I allowed to go abroad and take my baby with me? He doesn’t agree and he said he will do anything to don’t let me go. Even tho I told him he can came anytime to see our baby. Is he allowed to stop me? What would you advise me to do? Pls

Yes he can stop you , he has parental rights being on the birth certificate

How he can stop me?

Court order , anything that puts a hold on your passport and travel

What about if I leave before?

I think It could be classed as an abduction since he doesn't know about it

Primero que todo mucha fuerza y energías para salir adelante, lo vas a lograr 🫶🏻 si necesitas hablar o lo que sea no dudes en mandarme un mensaje por privado. Estoy en una situación no parecida pero tampoco distante, tengo entendido que para sacar niños del país británicos solo hace falta en consentimiento de uno de los padres pero claro que queda a discrecionalidad del agente de migraciones… Te recomendaría buscar apoyo en los family hubs de donde te encuentres, ellos te contactarán con social services y expón tu caso ahí.. entiendo que quieras regresar a casa pero aún así , si tu deseo es estar en el Uk con tu bebé, hay my has forma y vías, y dejando precedente en servicios sociales ellos harán un assessment y verán la manera de ayudarte en lo mayor posible. Por otro lado anda. A citizens advice, es un servicio orientación legal que te puede dar un mejor panorama sobre sacar a tu bebé fuera del país y con el tema del ..

.. consentimiento. Acá hay mucho apoyo por el lado de las autoridades, y dependiendo de cada caso en concreto te apoyan y siempre buscan el interés superior que es el bienestar de tu bb y de la madre también. Cómo te digo, busca opinions expertas por el lado legal
